Terms & Conditions
General Terms and Conditions (AGB) for the sale of digital courses to consumers.
1. Provider & scope
These terms apply to all contracts concluded via this website between you (the “customer”) and nachtgold studio, an online business based in Vienna, Austria, reachable at info@nachtgold.studio.
2. Products
We sell access to a digital, pre-recorded online watercolor course and related digital materials (the “course”), optionally together with bonus digital content. The specific contents are described on the sales page at the time of purchase.
3. Conclusion of contract
By clicking the payment button and completing checkout, you submit a binding offer to purchase the selected product. The contract is concluded once we confirm your order and/or provide access to the course. Checkout and payment are handled by our payment provider, Stripe.
4. Prices & payment
The price applicable is the one shown at checkout. As a small business under § 6 para. 1 no. 27 of the Austrian VAT Act (Kleinunternehmerregelung), no VAT is charged and prices are final. Payment is due immediately at checkout via the payment methods offered by Stripe.
5. Delivery & access to digital content
After successful payment, access to the digital course is provided electronically, normally immediately or shortly after purchase, using the email address you provided. Access to the online materials requires a suitable internet connection and device.
6. Right of withdrawal for consumers
As a consumer, you have the right to withdraw from a distance contract within 14 days without giving any reason.
7. 30-day money-back guarantee
On top of your statutory rights, we offer a 30-day money-back guarantee: if you are not satisfied for any reason, email info@nachtgold.studio within 30 days of purchase and we will refund your payment. This guarantee is granted voluntarily and does not limit your statutory rights as a consumer.
8. Licence & intellectual property
Upon purchase you receive a personal, non-transferable, non-exclusive licence to access and use the course for your own private, non-commercial use. You may not share, resell, distribute, publish or reproduce the course or its materials, in whole or in part, without our prior written consent.
9. Warranty (Gewährleistung)
The statutory warranty rights apply. If the digital content is defective, the statutory provisions on warranty for digital services apply.
10. Liability
The course is educational content provided in good faith; we do not guarantee any particular artistic outcome or result. To the extent permitted by law, our liability for slight negligence is excluded, except for damage to life, body or health. This does not affect any mandatory liability under the Austrian Product Liability Act or other mandatory law.
11. Governing law & jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer is habitually resident remain unaffected.
12. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
